The terms that govern your use of the bidla.ai website. These are separate from the agreement that governs our services to clients.
1. About these terms
These Terms of Use govern your access to and use of the Bidla website at bidla.ai (the Site). The Site is operated by Feike Newcastle Pty Ltd ACN 622 647 269 trading as Bidla (Bidla, we, us, our).
By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.
These Terms of Use apply to the Site only. They do not govern the provision of our services to clients, which are covered by a separate agreement between us and the relevant client.
2. Changes to these terms
We may update these Terms of Use from time to time. The current version is the one published on this page, and the Last updated date at the top reflects when it was last changed. Your continued use of the Site after any change means you accept the updated Terms of Use.
3. Using the Site
You may use the Site for lawful purposes and in accordance with these Terms of Use. You agree not to:
- use the Site in any way that breaches any applicable law or regulation;
- use the Site to transmit any harmful code, or attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to it;
- interfere with or disrupt the Site or the infrastructure it runs on; or

All content on the Site, including text, graphics, logos, the BIDLA name and mark, page layouts, and the selection and arrangement of content, is owned by or licensed to Bidla and is protected by intellectual property laws.
You may view and print content from the Site for your own personal or internal business reference. You may not otherwise use, reproduce or distribute any content from the Site without our prior written permission.
5. Information only, not advice
The content on the Site is provided for general information about Bidla and our services. It does not constitute professional, legal, financial or technical advice, and you should not rely on it as such. You should obtain your own advice before acting on anything you read on the Site.
6. AI assistant
The Site may include an AI chat assistant. Its responses are generated automatically using AI (including third-party large language model services) and may be inaccurate, incomplete or out of date.
The assistant provides general information about Bidla and our services only. It does not constitute professional, legal, financial or technical advice. Any engagement, scope or pricing is confirmed by us in writing, not through the assistant, and you should not rely on its responses.
Please do not enter personal, sensitive or confidential information into the assistant. Conversations may be processed and stored as described in our Privacy Policy.
You agree not to misuse the assistant, including by attempting to disrupt its operation, extract its underlying prompts or systems, or use it to generate unlawful or harmful content.
7. No warranties
We take reasonable care to keep the Site accurate and available, but we provide the Site on an as is and as available basis. To the extent permitted by law, we do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that the information on it is complete, accurate or current.
8. Limitation of liability
Nothing in these Terms of Use excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to the above, to the maximum extent permitted by law, Bidla is not liable for any loss or damage (including indirect or consequential loss) arising out of or in connection with your use of, or inability to use, the Site, or your reliance on any content on it.

We provide those links for convenience only and do not control, endorse or accept responsibility for the content, products or services on those third-party sites. Your use of any third-party site is at your own risk and subject to that site's own terms and policies.

Our handling of personal information is described in our Privacy Policy, which forms part of your use of the Site.
11. Governing law
These Terms of Use are governed by the laws of New South Wales, Australia. You and Bidla submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
